Terms and Conditions of Entry for the Liberation Day Prize Draws

Instructions on how to enter form part of the Conditions of Entry. By participating entrants agree to be bound by these Conditions.

1. The Promoter is Microsoft Pty Ltd, 1 Epping Road, North Ryde 2113. ABN: 29 002 589 460.
2. Entry is open to Australian residents. Employees of the Promoter, and their immediate families, its retailers, suppliers and associated companies and agencies are not ineligible to enter.
3. Promotion commences at 5pm (Sydney time) on 22/10/2008. Entries close 12:00pm (Sydney time) on 14/11/2008.
4. To enter the draw, the entrant must complete an online form at www.microsoft.com.au/powertodevelopers.
5. The winner will be drawn randomly from all valid entries received by the above mentioned date.
6. The draw will take place at 2:00pm (Sydney time) on November 28 at Microsoft offices.
7. The winner will be notified by email on December 3.
8. Only one entry per person. No responsibility will be taken for late, lost or misdirected entries.
9. The prizes are valued at $3,556.70 RRP as follows: Major Prizes x 2 ($778.85 each) Xbox 360 Pro console ($499), Gears of War 2 ($99.95), Fable 2 ($99.95), 3 month Xbox LIVE subscription ($29.95) and 3000 MS points ($50) Runner up prizes x 10 ($199.90 each): Xbox 360 games (1 x Fable 2 $99.95 and 1 x Gears of War 2 $99.95).
10. Prizes are not transferable and not redeemable for cash. If the Promoter is unable to supply the nominated prize, the Promoter reserves the right to supply another prize of greater or equal value.
11. All entries become the property of the Promoter. The Promoter’s decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the Promoter. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way.
12. If the prizes are not claimed within 3 months of the email, a second draw will be conducted to distribute the unclaimed prizes on 3rd March 2009 at 2pm. The winner in an unclaimed prize draw will be notified by email.
13. Subject to any applicable law which cannot be excluded, the Promoter and its related bodies corporate shall not be liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) and arising directly or indirectly out of or in connection with the promotion or any prize.
14. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who the Promoter believes either has tampered with the entry process or has submitted an entry that is not in accordance with these Conditions.
15. Stated prize values are the recommended retail value (including GST) in Australia as provided by the supplier and are correct at the time of printing. The Promoter accepts no responsibility for any variation in the value of a prize.
16. Tax implications may arise from the prize winnings. Independent financial advice should be sought.
17. Details from all entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for publicity purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described. Entrants may access and/or change their data by following the procedures in the Promoter’s privacy policy which is available at www.microsoft.com/australia/privacy. The Promoter will only use your personal details for marketing purposes outside those described above if you “opt in” to join the mailing list when prompted.
18. Winners will be published on www.microsoft.com.au/powertodevelopers by December 11 2008.
