Participation
  1. This promotion ("Promotion") is conducted by Microsoft Pty Limited (ABN 29 002 589 460), 1 Epping Road, North Ryde NSW 2113 ("Promoter").
  2. Information regarding prizes and how to enter forms part of these Terms and Conditions. Submission of an entry into this promotion is deemed to be acceptance of these Terms and Conditions. Entries not completed in accordance with these Terms and Conditions are ineligible.
  3. Entry is only open to permanent residents of Australia. Directors, management and employees (and their immediate families) of the Promoter, participating retailers, agencies and companies associated with this promotion are ineligible to enter. Entrants who are under the age of 18 years old must obtain their parent's consent before entering.
  4. The Major Prize promotion commences at 12:01am AEST on 1 November 2007 and final entries close at 11.59pm AEST on 29 February 2008 (Promotional Period). The Instant Win promotion commences at 12:01am AEST on 1 November 2007 and final entries close at 11.59pm AEST on 15 February 2008 (Instant Win Promotional Period). To be a valid entry, all of the necessary information must be included with an entry and the entry must be received by the Promoter during the applicable Promotional Period explained above.
Major Prize Draw
  1. To enter the Major Prize draw a consumer must purchase any Palm, i-mate, Motorola or HTC Windows Mobile 6 Device from an Australian retailer between 1 November 2007 and 29 February 2008 and enter online at www.windowsmobile.com.au/7wonders before 11.59pm AEST on 29 February 2008. The purchase must be made in Australia. Each entrant can enter as many times as they wish, provided that each entry is supported by an individual and separate product purchase. All entrants must retain purchase receipts as proof of purchase in order to claim a Major Prize.
  2. The Major Prize Draw will take place at 5th Finger, Level 7, Tower Building, Australia Square, 264 George Street, Sydney, NSW, 2000 at 10:00am AEST on 3 March 2008. The Promoter's decision is final and no correspondence will be entered into. The Major Prize Draw winners will be notified by phone and in writing within two days of the draw. The Major Prize Draw winners will have their names published in The Australian newspaper on 17 March 2008.
  3. Each of the first three valid entries drawn from all entries received in the Major Prize Draw will win a trip for two adults to their choice of one of the 7 wonders of the modern world. The 7 wonders of the modern world are: Colosseum in Rome; Great Wall of China; Taj Mahal, India; Petra in Jordan; Machu Picchu in Peru; Mt Corcovado looking down on Rio de Janeiro;
    Mayan temple city of Chichen Itza. Prize details for each destination are listed below:

  • Mayan temple city of Chichen Itza This prize includes return economy airfares for two adults flying Qantas Airways from Sydney to Los Angeles, return economy airfares for two adults flying Mexicana Airlines from Los Angeles to Cancun (return flight is via Mexico City), return airport transfers, 5 nights accommodation staying at the Marriott Casamagna Resort in an Ocean View room, no meals included and a Chichen Itza Tour with Lunch.
  1. The major draw prize will include return transfers to Sydney from the winner's nearest capital city (in the event that the winner does not live in New South Wales).
  2. All prizes must be taken between 10 March 2008 and 30 July 2008.
  3. The total value of each individual prize is up to $11,500 (depending on the winner's point of departure). The total maximum prize value of the major draw prizes is up to $34,500 inc GST (RRP value).
  4. It is a condition of accepting the prize that the winner may be requested to present their credit card upon arrival at any hotel to cover all incidental costs they may incur including their stay at the hotel.
  5. Total number of major prizes = 3. Travel prizes are subject to availability of flights, accommodation and other bookings. Travel arrangements are at the Promoter's discretion and dependent on the point of departure.
  6. All meals, beverages, extra activities, spending money and all other ancillary costs (including travel insurance) not expressly provided, as well as obtaining any of these, are the responsibility of the winner. In the event that, for any reason whatsoever, the winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize. The prize excludes Australian airport transfers, medical expenses, travel insurance, visas, passports, items of a personal nature, meals, beverages, optional tours, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. Any extension to the duration of the prize is at the winner's sole expense and subject to availability at the time of booking.
  7. The prizes are subject to the conditions of entry of other third party suppliers and the Promoter and its related bodies corporate are not responsible or liable for any direct or indirect loss suffered by any entrant as a direct or indirect result of the conduct of those suppliers.
Instant Win Prize Draw
  1. To enter the Instant Win prize draw entrants must SMS their full name, email address and postcode as follows:
  1. for entrants whose mobile phone is connected to the Hutchison 3G network, send your SMS entry to:
    (i) 199 11444 at any time during the Instant Win Promotional Period;or

Each entrant will receive:

  1. a reply SMS notifying them whether they have an instant prize and directing them to their nearest store to receive instructions on how to redeem their prize. On visiting their nearest store, winners will be directed to the Promotion website at www.windowsmobile.com.au/applications to receive further instructions and redeem their prize; and

  2. a reply email notifying them whether they have an instant prize and directing them to their nearest store or the Promotion website at www.windowsmobile.com.au/applications to receive further instructions and redeem their prize.
On visiting the website, the entrant will be asked to enter the same mobile number they used to enter the competition, their name and other specified details to validate their entry and permit them to redeem their prize.

  1. The Instant Win Prize Draws will take place randomly during the Instant Win Promotional Period at 5th Finger, Level 7, Tower Building, Australia Square, 264 George Street, Sydney, NSW, 2000. Only one entry per person per mobile number is allowed in the Instant Win Prize Draw. Duplicate entries will not be allowed.
  2. There will be a total of 1000 instant prizes during the Instant Win Promotional Period. The instant win prizes consist of 300 Texas Hold'Em Poker games valued at $23.70 each; 200 Splash ID mobile applications valued at $35.50 each; 300 World Mate travel applications valued at $41.42 each and 200 Im in One instant messaging applications valued at $47.36 each. The total prize pool value of the instant win prizes is $36,108.00 (incl GST). All prices are RRP as at the time of printing; actual prices may vary
  3. All valid entries received in the Instant Win Promotion will receive a 3 month MyDrive subscription (valued at $14.85 RRP) available as a phone or web-based application, regardless of whether they are a winner of an Instant Prize. Entrants will be able to redeem their MyDrive subscription from www.mydrive.com.au.
  4. All valid entries received in the Instant Win Promotion that do not win an application detailed in condition 17 will be entitled to a complimentary ringtone from the Promoter. Instructions for redeeming this ringtone will be communicated in the same manner as is detailed in condition 15.
  5. Premium SMS cost is 55c (inc GST). Entry is only open to entrants with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. The Promoter will record their mobile phone number and email address details so that the prize may be awarded. SMS entries via the Internet or from a mobile phone in which the mobile phone number is withheld are not valid. An entry is deemed to be received at the time of its receipt by the Promoter and NOT at the time of transmission by the entrant. Entries via SMS will only be accepted from mobile phones. Any form of automated entry using other devices or software is invalid.
  6. The mobile phone number from which the entrant sends the SMS entry must be owned by the entrant. The Promoter may require a winner to validate their entry by showing proof of ownership of the mobile telephone number.
  7. All valid claims for prizes will be met notwithstanding that the advertised prize pool has been exceeded. Printing errors or other quality control matters will not be used as the sole basis for refusing to award a prize. All instant prizes must be redeemed by 1 March 2008.
General
  1. Individuals must have access to the internet in order to participate in this Competition to win Instant Prizes and gain entry into the Major Prize Draw.
  2. All prizes must be taken as offered. The prizes, or any unused portion of the prizes, are not transferable or exchangeable and cannot be redeemed as cash. The prizes cannot be used in conjunction with any other special offer. The prizes are valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way. The Promoter and its associated agencies and companies accept no responsibility for prizes damaged or lost in transit.
  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS call costs. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. All entries become the property of the Promoter. The Promoter's decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the Promoter. Entries will be deemed void if incomplete, indecipherable, illegible, stolen, forged or mutilated in any way.
  5. Prizes are not transferable or exchangeable and cannot be redeemed for cash. All prizes are valued at their RRP as at the time of printing. The Promoter takes no responsibility for any variations in prize values
  6. If any prize is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if any prize (or any part of a prize) is unavailable for any reason.
  7. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
  8. The Promoter may conduct an unclaimed prize draw at the same place as the original draw, as is necessary on 17 June 2008 at 10.00am AEST in order to distribute any unclaimed prizes by that date, subject to any written directions from a regulatory authority. Winners will be notified in writing within two days of the draw and winners' names (for prizes valued at over $100) will be published in The Australian on 1 July 2008.
  9. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
  10. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication including any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, or otherwise, (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise).
  11. Subject to any applicable law which cannot be excluded, the Promoter and its related bodies corporate shall not be liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with the promotion or any prize.
  12. If a winner of the prize is under the age of 18 years, the prize will be awarded to the winner subject to the prior written consent of the winner's parent or legal guardian. The Promoter may make such inquiries as it deems necessary to satisfy itself that such consent has been obtained.
  13. Before the travel prizes are awarded, each winner, and any other persons sharing the prize with the winner, will be required to sign a form to release the Promoter from and indemnify the Promoter against, any and all liability arising from the use or participation in the prize.
  14. The Promoter assumes no responsibility for, and the entrant releases the Promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the entrant's participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an entrant's error, any technical problem of any kind including communications or network failure, unauthorised access to, transferring or theft of data, whether caused by the entrant or associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotion's administration, security, fairness or integrity are compromised or affected, the Promoter may (where necessary with the approval of the relevant Department) cancel, terminate, modify or suspend the promotion and/or disqualify any entrant involved in interfering or tampering with the conduct of this promotion in any way.
  15. Details from all entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for publicity purposes surrounding this promotion.
