5 for 15 Microsoft Dollars Terms & Conditions

Purchase Qualification

This offer is valid only for commercial customers, excluding academic customers purchasing under academic agreements. Eligible licenses for Microsoft Dollars are identified below along with registration guidelines. Nothing in these terms and conditions guarantees an organization will meet the eligibility requirements for enrolment and/or renewal in one of the Microsoft License programs. The following licenses are considered "Eligible Licenses" for this offer

  • Open Business with Software Assurance - $15,000 spent in upfront payment to qualify
  • Open Value (including company wide) - $15,000 spent in Year One payment
  • Open Value Subscription - $15,000 spent over 3 years combined payment (First Year payment must be a minimum of $5,000)

Eligible Licenses must be genuine licenses sold in Canada and intended for use in Canada and must be purchased from a Registered, Certified or Gold Certified Partner that is a member of the Microsoft Partner Network in order to qualify for Microsoft Dollars ("Authorized Selling Partners").

The Microsoft Dollars may be used with any Registered, Certified or Gold Certified Partner in the Microsoft Partner Network for any future Microsoft software purchases excluding Windows. Microsoft Dollars must be used by June 30th 2011.

Qualified Organizations may not participate in this offer if they are participating in any other Microsoft cash rebate or partner subsidy.

Registration Requirements and Limits

This offer is good for qualifying purchases made between October 1st, 2010 through December 31, 2010 from Authorized Selling Partners.

Notice will be provided only on the landing page http://www.microsoft.com/canada/smb/value-of-vl/5-for-15-offer.aspx. No individual notice will be provided if the offer is cancelled or extended. Please check http://www.microsoft.com/canada/smb/value-of-vl/5-for-15-offer.aspx for offer availability before purchasing.

The 5 for 15 Microsoft Dollars provides $5,000 Microsoft Dollars to a Qualified Organization after purchasing $15,000 of Eligible Licenses (excluding taxes). The $15,000 Eligible License minimum is based on Microsoft’s estimated retail price, visit the Canadian Microsoft ERP landing page for full product price details http://www.microsoft.com/canada/pricelists/. Qualified Organizations must successfully register their purchase at http://www.microsoft.com/canada/smb/value-of-vl/5-for-15-offer.aspx by 5:00pm PDT on January 31, 2011 to receive Microsoft Dollars. If the Qualified Organization fails to register by 5:00pm PDT on January 31, 2011 it forfeits the right to receive any Microsoft Dollars. The licenses will be validated as eligible during the registration process. Qualified Organizations are able to submit only one claim throughout the duration of the offer.

Purchase Time Period: October 1st, 2010 through December 31st 2010. Registration Deadline: Before 5:00 p.m. PDT January 31, 2011. A Qualified Organization includes the Qualified Organizations Affiliates. "Affiliate" means any legal entity that owns, is owned by, or that is under common ownership with Customer (ownership means control of more than a 50% interest).

Provided the entity is a Qualified Organization that purchases Eligible Licenses from an Authorized Selling Partner and registers its license purchases by 5:00pm PDT on January 31, 2011, the Qualified Organization will receive Microsoft Dollars for the Eligible Licenses purchased during the Purchase Time Period.

Microsoft reserves the right to change the products for this offer without notice. Customers and technology partners are responsible for reviewing the landing page to ensure their purchase qualifies for Microsoft Dollars.

License Exclusions

Microsoft Dollars are not earned or available for purchases of the following licenses:

  • Enterprise Agreement and Enterprise Subscription Agreement Program Licenses
  • Select Program Licenses
  • Any Software Assurance ("SA") only purchase; except Open Value Software Assurance if purchased within ninety days of the L purchase.
  • Not-For-Resale products
  • Full Package Product ("FPP")Academic Edition ("AE") products
  • Academic License Agreements
  • Software acquired through charity pricing, TechNet or MSDN® Subscriptions
  • Software acquired through ISV Royalty or Services Provider License Agreement ("SPLA" Programs)
  • Upgrade licenses (if available)
  • Software that is intended for distribution outside of Canada
  • Purchases of qualifying licenses that have been previously returned
  • OEM Software Licenses
  • All Level C programs
  • Partner-only SKU's

Product Exclusions
Qualified Organizations must meet the minimum deal size of $15,000 excluding any purchases of Windows.

Microsoft Dollars Utilization
Microsoft Dollars received as part of this offer must be used to pay for future purchases of Microsoft software excluding Windows from a technology partner who is a member of the Microsoft Partner Network and who is selected by the Qualified Organization ("Selected Partner"). Partners cannot participate in the 5 for 15 Microsoft Dollars to receive Microsoft Dollars to use for their own business. Partners can be selected at: https://partner.microsoft.com/Canada/Partner

Microsoft Dollars Utilization Exclusions
Microsoft Dollars will be provided in a cheque format and will expire on June 30th 2011. Microsoft Dollars are NOT to be given to a partner as a credit (i.e. on account) to pay for Microsoft software purchases that begin after the June 30th 2011 expiration date. Qualified Organizations may not receive a cash payout from the Selected Partner for any portion of the Microsoft Dollars amount. Microsoft reserves the right to request proof of purchase (e.g. invoice) by Qualified Organizations to verify purchase of Microsoft software sold by their Selected Partner. Microsoft also has the right to contact the Selected Partner to verify the products sold.

Microsoft Dollars Payment Information
Microsoft Dollars will be sent to the Qualified Organization within eight (8) weeks of the claim being approved. The Microsoft Dollars cheque will be payable to the Selected Partner. The Qualified Organization will deliver the cheque to the Selected Partner upon purchase of products from the Selected Partner. The payment is contingent upon Microsoft's verification that all of the criteria in these terms and conditions have been met.

Returns
If Microsoft Dollars are paid based upon the purchase of licenses by the Qualified Organizations that are subsequently returned, the Qualified Organization must reimburse Microsoft for the Microsoft Dollars paid based upon the purchase of those returned licenses. Microsoft reserves the right to follow-up with technology partners/customers who have used a Microsoft Dollar cheque after returning the software.

Country
Offer valid in Canada only and only for products that will purchased and used in the country. Offer void where prohibited, taxed, or restricted by law.

Limitation of Liability
Qualified Organizations are responsible for contracting directly with their Selected Partner for any products to be provided and paid for in whole or in part by the Microsoft Dollars. Qualified Organizations are responsible for submitting the Microsoft Dollars cheque to their Selected Partner, and for paying any amount owed in excess of the amount of the Microsoft Dollars. The Selected Partner does not represent or act as an agent for Microsoft. IN NO EVENT SHALL MICROSOFT HAVE ANY OBLIGATION OR LIABILTY WHATSOEVER IN RELATION TO THE PRODUCTS PROVIDED BY THE SELECTED PARTNER UNDER THIS OFFER.
