Privacy Statement

Microsoft is committed to protecting your privacy, while delivering software that brings you the performance, power and convenience you desire in your personal computing. This privacy statement explains many of the data collection and use practices of Microsoft Windows Essential Business Server (“ Windows Essential Business Server”). This statement focuses on features that communicate with the Internet and does not apply to other online or offline Microsoft sites, products or services.

Collection and Use of Your Information

The information we collect from you will be used by Microsoft and its controlled subsidiaries and affiliates to provide the service(s) or carry out the transaction(s) you have requested or authorized, and may also be used to request additional information on feedback that you provide about the product or service that you are using; to provide important notifications regarding the software; to improve the product or service, for example bug and survey form inquiries; to provide you with advance notice of events; or to tell you about new product releases.

Except as described in this statement, personal information you provide will not be transferred to third parties without your consent. We occasionally hire other companies to provide limited services on our behalf, such as packaging, sending and delivering purchases and other mailings, answering customer questions about products or services, processing event registration, or performing statistical analysis of our services. We will only provide those companies the personal information they need to deliver the service, and they are prohibited from using that information for any other purpose.

Information that is collected by or sent to Microsoft may be stored and processed in the United States or any other country in which Microsoft or its service providers, subsidiaries or service providers maintain facilities. Microsoft abides by the safe harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Union.

Microsoft may disclose personal information about you if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Microsoft; (b) protect and defend the rights of Microsoft (including enforcement of our agreements); or (c) act in urgent circumstances to protect the personal safety of Microsoft employees, users of Microsoft products or services, or members of the public.

Collection and Use of Information About Your Computer

This software contains Internet-enabled features that collect certain standard information from your computer ("standard computer information") and send it to Microsoft. Standard computer information typically includes information such as your IP address, operating system version, browser version, and regional and language settings. In some cases standard computer information may also include hardware ID, which indicates the device manufacturer, device name, and version. If a particular feature or service sends information to Microsoft, standard computer information will be sent as well. Because this is a pre-release version of the software, some of these Internet-enabled features are turned on by default, so that we can collect enough information about how the software is working in order to improve the commercially released software. The default settings in this pre-release software do not necessarily reflect how these features will be configured in the commercially released software.

The privacy details for each Windows Essential Business Server feature, software or service listed in this privacy statement describe what additional information is collected and how it is used.

Security of Your Information

Microsoft is committed to protecting the security of your information. We use a variety of security technologies and procedures to help protect your information from unauthorized access, use, or disclosure. For example, we store the information you provide on computer systems with limited access, which are located in controlled facilities.

Changes to This Privacy Statement

We will occasionally update this privacy statement to reflect changes in our products and services and customer feedback. When we post changes to this Statement, we will revise the "last updated" date at the top of this statement. If there are material changes to this statement or in how Microsoft will use your personal information, we will notify you either by prominently posting a notice of such changes prior to implementing the change or by directly sending you a notification. We encourage you to periodically review this statement to be informed of how Microsoft is protecting your information.

Customer Experience Improvement Program

What This Feature Does:

The Customer Experience Improvement Program (“CEIP”) collects basic information about your hardware configuration and how you use our software and services to identify trends and usage patterns. CEIP also collects the type and number of errors you encounter, software and hardware performance, and the speed of services. This information is sent to Microsoft, where we use them to help improve the features our customers use most often and to create solutions to common problems.

Information Collected, Processed, or Transmitted:

CEIP will send to Microsoft information about the servers running Windows Essential Business Server and included server applications: Microsoft® SQL Server® 2005; Microsoft® System Center Essentials; Microsoft® Forefront™ Threat Management Gateway, Medium Business Edition.

Use of Information:

We use this information to improve the quality, reliability, and performance of Microsoft software and services.

Microsoft Error Reporting

What This Feature Does:

The Microsoft Error Reporting feature allows you to automatically report problems you may be having on servers running Windows Essential Business Server to Microsoft. You can also receive information that may help you avoid or solve such problems by opening the Problem Reports and Solutions control panel.

Information Collected, Processed, or Transmitted:

Each time an error occurs on a Windows Essential Business Server, a report is generated. When you choose to participate in Microsoft Error Reporting, the report will be sent to Microsoft.

The Microsoft Error Reporting feature collects Internet Protocol (IP) addresses, which are not used to identify users. It does not intentionally collect anyone's name, address, email address, computer name, or any information that will be used to identify you or contact you. It is possible that such information may be captured in memory or in the data collected from open files, but Microsoft does not use it to identify you.

In rare cases, such as problems that are especially difficult to solve, Microsoft may collect additional data, including sections of memory (which may include memory shared by any or all applications running at the time the problem occurred), some registry settings, and one or more files from your computer. Data associated with your active session may also be included.

When you choose to participate in Microsoft Error Reporting during setup or from the Essential Business Server Administration Console, reports from all servers running Windows Essential Business Server and included server applications, Microsoft® Exchange Server Standard Edition 2007 and Microsoft® System Center Essentials, will be sent to Microsoft.

Use of Information:

We use this data to help solve customer problems and improve our software.

Choice/Control:

During installation you are required to make an explicit choice regarding your participation in Microsoft Error Reporting. You may opt out during set-up (not recommended).

To turn Microsoft Error Reporting on or off later:

  1. Start the Windows Essential Business Server Administration Console.

  2. From the Help menu, select Error Reporting Options…

  3. To turn Microsoft Error Reporting off, select Do not automatically report problems.
To turn Microsoft Error Reporting on, select Automatically report problems (recommended).

  4. Click OK.

Important Information:

For additional, general information about Microsoft Error Reporting, see http://go.microsoft.com/fwlink/?LinkId=102053.

For more details on what information is collected and how it is used, see the Microsoft Error Reporting privacy information at http://go.microsoft.com/fwlink/?LinkId=94957.

Microsoft Update

Important Information:

If you have Internet connectivity, Windows Essential Business Server uses Microsoft Update during setup to download and install updates. Microsoft Update will automatically download and install critical updates; you can also choose to download and install optional updates. For more details on what information is collected and how it is used, see the Microsoft Update privacy statement at http://go.microsoft.com/fwlink/?LinkId=105236.

Licensing Activation

What This Feature Does

Licensing Activation is aimed at reducing software counterfeiting, helping to ensure that Microsoft customers receive the software quality that they expect. Once your software or a client access license pack is activated, a specific product key becomes associated with the server on which the software is installed. This association prevents the product key from being used to activate the same copy of the software on multiple computers as counterfeit software. Some changes to your computer components or the software may require you to reactivate the software.

Information collected, processed, or transmitted

During activation of software or a client access license pack, product key information is sent to Microsoft along with a hardware hash, which is a non-unique number generated from the computer's hardware configuration. The hardware hash does not represent any personal information or information about the software or client access license pack. The hardware hash cannot be used to determine the make or model of the computer and it cannot be backward calculated to determine any additional information about your computer. Along with standard computer information, some additional language settings are collected.

Use of information

Microsoft uses the information to confirm that you have a licensed copy of the software, and then it is aggregated for statistical analysis. Microsoft does not use the information to identify you or contact you.

Choice and control

Activation is mandatory. If you choose not to activate the software, you cannot use it, although in some cases a grace period will apply. If the software is not correctly licensed, you will not be able to activate it.
