Exchange includes valuable features that can enable an organization to better manage the retention of its employees’ voice mail, fax and e-mail messages including: (1) election of the document types to retain; (2) selection of different retention periods for different document types; and (3) tools to automatically retain documents related to a given business project for a set period of time.
This paper reviews whether this change in an organization’s communications storage technology results in any change in legal obligations for companies in regulated industries, and concludes that no aspect of Exchange alters, by increasing or decreasing, the record retention obligations of these organizations in the U.S. or E.U. The paper also provides an overview of other more general document retention issues that may arise in the U.S. and E.U. for unregulated industries from litigation, government investigations, or law enforcement requests.
