Microsoft Files Petition for Writ of Certiorari, Requesting Review of Key Issue by U.S. Supreme Court
Microsoft today filed a Petition for Writ of Certiorari, requesting a review by the Supreme Court of a key issue in the antitrust case: the question of judicial bias. At the same time the Company filed a Motion for Stay of the Mandate Pending Petition for Writ of Certiorari.

The Court of Appeals description of the district judge's actions during trial speak for themselves: "These violations were deliberate, repeated, egregious, and flagrant….Given the extent of the Judge's transgressions in this case, we have little doubt that if the parties had discovered his secret liaisons with the press, he would have been disqualified, voluntarily or by court order."

While we remain committed to resolving the remaining issues and to settling this case as quickly as possible, a stay is warranted. Otherwise we will continue to hold further proceedings on the basis of a record that may prove in the end to be of no avail.
