Nine States Join MS-DoJ Settlement
On Tuesday, November 5, nine of the 18 suing states joined Microsoft and the Department of Justice in the agreement they reached last Friday. The states joining in the settlement are New York, Kentucky, Ohio, Illinois, Maryland, North Carolina, Michigan, Wisconsin and Louisiana.

Nine other states -- California, Connecticut, Florida, Iowa, Kansas, Massachusetts, Minnesota, Utah and West Virginia - and the District of Columbia have not yet settled.

Microsoft believes the settlement is a fair and reasonable compromise that is good for consumers, good for the high-tech industry and good for the U.S. economy overall. The proposed consent decree was arrived at after extensive, intensive negotiations with a court-appointed mediator, and it has the full support of the U.S. Attorney General.

Judge Colleen Kollar-Kotelly has ordered both aspects of the case to move forward. The public review of the proposed settlement will occur over roughly the next two months. At the same time, barring a settlement between all parties, discovery and depositions will get underway in the litigation involving the States that did not settle, with remedy hearings likely in March.

The FIN will continue to update you as events develop throughout the week.

As always, it is important to let your elected officials know how you feel about their actions on issues affecting Microsoft and the industry. We urge you also to take the time to thank those Attorneys General who have joined today's settlement.
