X "Windows Server 2012 Corporate IT Quiz" Terms and Conditions

THESE ARE THE TERMS AND CONDITIONS THAT GOVERN HOW THE "WINDOWS SERVER 2012 CORPORATE IT QUIZ" ("COMPETITION") OPERATES ("TERMS AND CONDITIONS" ). IN THESE TERMS AND CONDITIONS, "WE", "US", "OUR" AND "MICROSOFT" REFER TO MICROSOFT HONG KONG LIMITED. "YOU", "YOUR" AND "YOURSELF" REFER TO AN ELIGIBLE COMPETITION PARTICIPANT. EVERY E-MAIL AND ITS CONTENTS (INCLUDING ALL INFORMATION CONTAINED THEREIN) SUBMITTED FOR THIS COMPETITION WILL CONSTITUTE AN "ENTRY". PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING IN THE COMPETITION, AS THEY FORM A LEGALLY BINDING AGREEMENT BETWEEN YOU AND MICROSOFT. BY PARTICIPATING IN THE COMPETITION, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD AND FULLY AGREE TO AND UNCONDITIONALLY ABIDE BY THESE TERMS AND CONDITIONS.

  1. This Competition is only open to Hong Kong residents aged 18 years or above at the time of participation. Employees of Microsoft and their immediate families, retailers and suppliers of Microsoft product(s) or services and their associated companies and agents are not eligible to participate.
  2. This is a skill-based competition and chance plays no part.
  3. This Competition will commence on 16 November 2012 (Friday) and close on 13 December 2012 (Thursday) (the "Competition Period").
  4. The Competition will be conducted in 4 weekly stages:

    Week 1 16 November 2012 (Friday) to 22 November 2012 (Thursday)
    Week 2 16 November 2012 (Friday) to 22 November 2012 (Thursday)
    Week 3 30 November 2012 (Friday) to 6 December 2012 (Thursday)
    Week 4 7 December 2012 (Friday) to 13 December 2012 (Thursday)

    At 00:00 on each Friday during the Competition Period, Microsoft will upload two (2) questions on the Windows Server 2012 Corporate IT Quiz website located at http://www.microsoft.com/hk/ws2012/game/english/ (the "Competition Website"). In order to participate, you must provide and send your answers to the two questions together with your full name by e-mail to the e-mail address itprohk@microsoft.com, using the subject heading "Windows Server 2012 Corporate IT Quiz - Week [X]" ("X" denoting the week of the Competition). The first five (5) participants with the correct answers in each competition week will be the winners. Each of the winners will receive one Arc Touch mouse (the "Prize").
  5. Each winner can only receive a maximum of one Prize per week in this Competition.
  6. All data transfer and reception time shall be determined according to Microsoft's server, and subject to Microsoft's final decision. Microsoft is not responsible for any data which is transmitted late, lost, or incorrectly uploaded to other websites. We are not liable for any data which we are unable to receive or delayed in receiving (including any delay due to inaccurate information provided by the participants or communication problem), or any information which we have received but for any reason is incomplete or illegible.
  7. By participating in the Competition, you represent and warrant that all data and information you provide is complete and accurate. If the details you provide are incomplete or inaccurate (including but not limited to any false e-mail address), inappropriate or illegible, or you impersonate another person or company to participate, Microsoft will in its sole and absolute discretion disqualify your eligibility to participate in this Competition.
  8. Winners will be notified within 6 weeks from the close of the Competition by email and provided with instructions for winner verification and redemption of their Prize ("Instructions"). If a potential winner cannot be contacted via email, is ineligible or fails to claim their Prize in accordance to the Instructions, the potential winner is deemed to forfeit the Prize. Microsoft can in its sole and absolute discretion to give the Prize to another winner. In the event of a dispute, all decisions of Microsoft shall be final and binding.
  9. The Prizes are provided on an "as is", "with all faults" and "as available" basis. To the maximum extent permitted by law, Microsoft is not liable for, and does not provide any warranties in relation to, the quality, fitness for purpose, performance, maintenance or repair of the Prize. Any enquiries relating thereto should be directed to the relevant supplier / manufacturer. You agree that Microsoft will not be responsible or liable for any loss, damage or personal injury resulting from the use of the Prize.
  10. If for any reason the Prize designated by Microsoft is unavailable, Microsoft reserves the right to substitute a prize(s) of equal or greater value. Winners agree that they may not exchange the Prize for cash or any other merchandise or services from Microsoft and shall be solely responsible for all applicable taxes related to accepting the Prize.
  11. You agree to hold Microsoft harmless from, and commit to indemnify Microsoft for any claim or demand, including reasonable legal fees, made by any third party in connection with your breach of these Terms and Conditions, or your violation to any law or the rights of a third party.
  12. To the maximum extent permitted by law, Microsoft assumes no responsibility for, and you release Microsoft from responsibility for, any loss, claim, damage or injury as a result of any events that cannot be reasonably anticipated or controlled by Microsoft, including but not limited to any technical problem, network failure, software and/or hardware failure. If, because of any such problem, this Competition is not able to be conducted as planned and/or the Competition's administration, security, fairness or integrity are compromised or affected, Microsoft can immediately and without notice cancel, terminate, modify or suspend the Competition and/or disqualify any participant involved in interfering or tampering with the conduct of this Competition in any way.
  13. To the maximum extent permitted by law, Microsoft shall not be liable for any indirect, special or consequential loss or damage that you may suffer in connection with the Competition or any of the matters detailed in paragraph 12 of the Terms and Conditions, and Microsoft's total liability in connection with such matters shall be limited to the sum of HK$100.
  14. Microsoft reserves the right in its sole and absolute discretion to disqualify any participant which Microsoft has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the Competition. Microsoft reserves all legal rights to recover damages or other compensation from such a participant.
  15. Microsoft has the right at any time to change or discontinue the Competition or any aspect of it. Microsoft will announce any substantive change to the Competition by posting it on the Competition Website. Any changes or discontinuation will take effect from the date of publication. Your continued participation in the Competition will constitute acceptance to any changes made by Microsoft. If you do not agree with any changes you should withdraw from the Competition. You agree that Microsoft shall not be liable to you for any loss or damages arising as a result of any such changes or discontinuation.
  16. This Competition and the Terms and Conditions shall be governed and construed in accordance with the laws of Hong Kong SAR and the courts of Hong Kong SAR shall have jurisdiction to hear all disputes relating to them.
  17. All provisions of the Terms and Conditions shall apply to the maximum extent permitted by law. If any provision of these Terms and Conditions shall be held to be unlawful, void or unenforceable, then such provision shall be replaced with terms and conditions that most closely match the intent of Microsoft and the remainder of the Terms and Conditions shall continue in full force and effect.
  18. Microsoft Hong Kong Limited of 13/F., Cyberport 2, 100 Cyberport Road, Hong Kong is the sponsor of this Competition.
  19. The personal data you provide to Microsoft is being collected for the purpose of administering and promoting this Competition, and will only be used for these purposes or other directly related purposes. In addition, you expressly agree and allow Microsoft to transfer the personal data that you provide to such third parties authorized by Microsoft solely for the purpose of administering this Competition. The Microsoft Privacy Rights Statement applies to this Competition and all information we receive relating to the entries you submit in participating in this Competition. Prior to accepting the Terms and Conditions and submitting your entries for this Competition, please first review the Microsoft Privacy Rights Statement at http://www.microsoft.com/privacystatement/en-hk/core/default.aspx. Please note that accepting the Terms and Conditions means that you also accept the terms of the Microsoft Privacy Rights Statement. Pursuant to this, all participants in this Competition also grant to Microsoft the right to, without providing compensation, communicate their details, names and related information (including any company details and names, if applicable) on the Internet and in written form.
  20. In case of any inconsistency between the English version and Chinese version of these Terms and Conditions, the English version shall prevail.
