Employees of Microsoft Taiwan and their lineal relatives, the employees
of the co-organizers of the Event, including the Executer, the
ceremonial organizers, public relations company, and production company,
and their lineal relatives are not allowed to participate in the Event. | | 2. |
The drawing will be made by random choosing from among the
participants. Each qualified participant could only be awarded one
prize. In the event of a participant’s name being drawn more than
once, Microsoft Taiwan and the co-organizers reserve the right to
disqualify the winner concerned. | | 3. |
Microsoft Taiwan and the Executer of the Event may disqualify
participants who provided false/incorrect information when
registering for participation in the Event, such that that cannot be
notified upon winning or participants who violate the Rules of the
Event. | | 4. |
The awards are not transferable. Winners shall duly abide by
applicable legal rules on taxation. Microsoft Taiwan and the
co-organizers of the Event disclaim any liability for applicable
tax, dues, or fees deriving from the awards. It is the
responsibility of the winners to declare and pay applicable taxes
and fees.
Where the winners may be subject to taxation under the applicable
tax code in the Republic of China, the winners shall be responsible
for abiding by the rules. According to the “Standards of Withholding
Rates for Various Incomes” issued by the Ministry of Finance, awards
from drawings shall be subject to taxation as follows: If the
winner is a natural person residing in the Republic of China, 10% of
the prize in cash or in kind awarded shall be subject to taxation.
If the amount of withholding tax is less than NT$ 2,000, withholding
of tax is exempted. The winner only has to fill out a withholding
exemption certificate. In other words, if the prize has a value of
NT$20,000 or more, then 10% withholding tax shall be applicable. If
the value of the prize awarded to a particular winner is less than
NT$1,000, no withholding tax shall be applicable and no withholding
exemption certificate is required. If the winner is a natural person
not residing in the Republic of China, withholding tax of 20% is
applicable irrespective of the value of the prize in cash or in
kind. For further reference, please visit the website of the

http://www.ntact.gov.tw/.
When it is necessary to withhold tax for prizes with values
exceeding NT$20,000, the winner should provide a clear photocopy of
both sides of his or her ROC Citizen Identity Card and the original
copy of the Payment Certificate for Tax Withholding for Various
Incomes (red) to the Executor. The winner may also assign the
Executor to pay such tax for him or her by paying it in cash on the
event day. If the value of the prize is higher than NT$1,000 and
lower than NT$20,000, please provide a clear photocopy of both sides
of the winner’s ROC Citizen Identity Card. The Executer will mail
the prize upon receiving the said documents and/or the payment for
withholding tax. Winners who are unable to collect their prizes on
the event day may collect them from the Executor (Miss Chen, 11/F, 6
Nanjing East Road Section 2, Taipei City; Phone: 02-25622880#3673)
with the above documents by 18 June, 2010. Winners should also pay
the relevant tax before collecting the prizes. Failure to collect
prizes by this date shall be considered as a waiver. [Note: please
confirm whether the prizes will be mailed by the Executor or
collected by the winners. ] | | 5. |
Microsoft Taiwan reserves the right to amend the Rules of the Event
without further notice or interpretation, but will make a public
announcement in advance. | | 6. |
The prizes for the Event are sponsored by vendors. In the event that
prize items are defective, please contact the appropriate vendor
directly. Microsoft Taiwan has no any liability for damage caused by
defective items awarded. | | 7. |
The participants agree that Microsoft Taiwan and the co-organizers
may use their names, e-mail addresses, mailing addresses and
telephone numbers as registered for the purpose of award notice and
delivery of the prizes. When participating in the Event, the
participants also agree that Microsoft Taiwan and the co-organizers
may refer their names, e-mail addresses, mailing addresses and
telephone numbers as registered to third parties for the purpose of
delivering the prizes. The prizes shall be deemed to have been
delivered upon the signing of the receipt for the prizes or
redemption coupons. Microsoft Taiwan will not provide supplementary
items in case of missing items, fraudulent claims or damage to the
prizes. [Note: If the winners have to collect the prizes on the
event day or at the business office of the Executor, please confirm
whether this paragraph is still applicable.] | | 8. |
The participants shall agree to accept telephone calls, e-mails, or
SMS messages sent by the Organizer respecting the Event. | | 9. | Winners failing to claim the prizes at the designated venue by the deadline shall be deemed to have abandoned the right to such claim and shall be disqualified from being awarded the prizes. The winners shall not have any objection. | | 10. | Microsoft Taiwan retains full rights with respect to handling any prize not awarded, and the right to substitute such award with other items of equivalent value for the Event without further notice or announcement. | | 11. |
In case the Event cannot be held as scheduled, Microsoft Taiwan reserves
the right to cancel, terminate, revise or suspend the Event or
reschedule the Event. | | 12. |
The participants agree to be bound by the aforementioned rules
applicable to the Event. |
