Bing Conversational Experiences and Image Creator Terms
- Eligibility and Use Requirements. To use the Online Services, you must have a current Microsoft account, and you must be a signed-in Microsoft Rewards user. After initial roll-out of the Conversational Experiences, which will be limited to users who sign-up to the experience waitlist, and are selected to use the Conversational Experiences, we may not require you to be signed in with your Microsoft account or be signed-in to Microsoft Rewards. Your use of the Online Services is governed by these terms (this "Agreement"), as well as the Microsoft Services Agreement, which is incorporated by reference. You agree that the Online Services constitute a Service, as defined in the Microsoft Services Agreement. If there is any conflict between this Agreement and the Microsoft Services Agreement, the conflicting provision in this Agreement will control.
Your use of the Online Services is also subject to the Microsoft Privacy Statement, which describes our collection, use and disclosure of information relating to your use of the Online Services. - Conversational Experiences Waitlist. The Conversational Experiences and other related features will initially not be available to all Bing users. They will be available only to users who request to be added to a waitlist and then after signing up for such waitlist, Microsoft will have the right in its sole discretion to add users to the Online Services, however Microsoft so determines.
- Using the Online Services. Bing Image Creator and Conversational Experiences both allow you to submit text inputs ("Prompts"). In the case of Bing Image Creator, it may allow you to generate images ("Image Creations") based on your Prompts. In the case of the Conversational Experiences, it may allow you to submit Prompts and converse with an online computer-powered chatbot and in certain circumstances generate text content ("Text Creations," and together with Image Creations, the "Creations"). Your use of the Online Services must comply with the Online Services Code of Conduct ("Code of Conduct"). By using the Online Services you are affirming that you have read the Terms of Use and Code of Conduct, understand it, and agree to abide by it.
You must use the Online Services and the generated Creations only (i) in a lawful manner and in compliance with all applicable laws; (ii) in accordance with this Agreement, the Code of Conduct, Microsoft Services Agreement, or other Microsoft documentation directed to the Online Services; and (iii) in a manner that does not infringe or attempt to infringe, misappropriate or otherwise violate any of our rights or those of any other person or entity (for clarity, "manner" includes without limitation the method, purpose and/or means of causing or attempting to cause the Online Services to generate content).
Due to the nature of the Online Services, Creations may not be unique across users and the Online Services may generate the same or similar output for Microsoft or other users. Other users may also ask similar questions and receive the same, similar or different responses.
These Online Services, including machine to human conversational interactions, may include advertising. - Violations. Serious or repeated violations of the Code of Conduct may result in your suspension from whichever Online Services were involved in the violations or, potentially, all of the Online Services and other Services (as defined in the Microsoft Services Agreement). You may appeal against your suspension from the applicable Service by submitting an appeal through the relevant Service user interface. We reserve the right to permanently suspend your use of the Online Services.
- Suspension and Cancellation. In addition to paragraph 4, we reserve the right to suspend or discontinue offering or supporting all or part of any of the Online Services at any time and for any reason, to some or to all customers. Subject to the requirements of law, we may limit, suspend, or terminate your use of any of the Online Services at any time without notice and for any reason, including (without limitation) if you breach this Agreement (including by failing to comply with the Code of Conduct), if we suspect you are engaged in fraudulent or illegal activity, or if your Microsoft account is suspended or closed by us or by you.
- Redeeming Bing Rewards – Bing Image Creator. You may redeem Microsoft Rewards for Bing Image Creator boosts to expedite the generation of Image Creations.
- Use of Creations. Subject to your compliance with this Agreement, the Microsoft Services Agreement, and our Content Policy, you may use Creations outside of the Online Services for any legal personal, non-commercial purpose.
- Ownership of Content. Microsoft does not claim ownership of Captions, Prompts, Creations, or any other content you provide, post, input, or submit to, or receive from, the Online Services (including feedback and suggestions). However, by using the Online Services, posting, uploading, inputting, providing or submitting content you are granting Microsoft, its affiliated companies and third party partners permission to use the Captions, Prompts, Creations, and related content in connection with the operation of its businesses (including, without limitation, all Microsoft Services), including, without limitation, the license rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat the Captions, Prompts, Creations, and other content you provide; and the right to sublicense such rights to any supplier of the Online Services.
No compensation will be paid with respect to the use of your content, as provided herein. Microsoft is under no obligation to post or use any content you may provide, and Microsoft may remove any content at any time in its sole discretion.
You warrant and represent that you own or otherwise control all of the rights to your content as described in these Terms of Use including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the content. - No Guarantees; No Representations or Warranties; Indemnification by You. We plan to continue to develop and improve the Online Services, but we make no guarantees or promises about how the Online Services operate or that they will function as intended. The Online Services are for entertainment purposes; the Online Services are not error-free, may not work as expected and may generate incorrect information. You should not rely on the Online Services and you should not use the Online Services for advice of any kind. Your use of the Online Services is at your own risk.
Without limiting Section 12 of the Microsoft Services Agreement in any way, but for the sake of clarity, Microsoft does not make any warranty or representation of any kind that any material created by the Online Services does not infringe the rights of any third party in any subsequent use of the content you may use (including but not limited to copyright, trademark, rights of privacy and publicity, and defamation). You must use any content from the Online Services in accordance with applicable law and subject to any third-party rights. In addition, you agree to indemnify and hold harmless Microsoft, its affiliates, employees and any other agents from and against any claims, losses, and expenses (including attorneys' fees) arising from or relating to your use of the Online Services, including your subsequent use of any content from the Online Services and your breach of these Terms, the Microsoft Services Agreement, the Code of Conduct or violation of applicable law. - IF YOU LIVE IN (OR YOUR PRINCIPAL PLACE OF BUSINESS IS IN) THE UNITED STATES, PLEASE READ THE BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER IN SECTION 15 OF THE MICROSOFT SERVICES AGREEMENT. - Not to engage in activity that is harmful to you, the Online Services, or others. Do not attempt to create or share content that could be used to harass, bully, abuse, threaten, or intimidate other individuals, or otherwise cause harm to individuals, organizations, or society.
- Not to engage in activity that violates the privacy of others. Do not attempt to create or share content that could violate the privacy of others, including disclosure of private information (sometimes known as "doxing"). Not to engage in activity that is fraudulent, false, or misleading. Do not attempt to create or share content that could mislead or deceive others, including for example creation of disinformation, content enabling fraud, or deceptive impersonation.

- Not to do anything illegal. Your use of the Online Services must comply with applicable laws.

By using the Online Services you agree:
- Not to engage in activity that is harmful to you, the Online Services, or others. Do not attempt to create or share content that could be used to harass, bully, abuse, threaten, or intimidate other individuals, or otherwise cause harm to individuals, organizations, or society.
- Not to engage in activity that violates the privacy of others. Do not attempt to create or share content that could violate the privacy of others, including disclosure of private information (sometimes known as "doxing"). Do not attempt to use the Online Services for facial identification, or identification verification purposes. Do not input photographs or video/audio recordings of others taken without their consent for the processing of an individual's biometric identifiers or biometric information.
- Not to engage in activity that is fraudulent, false, or misleading. Do not attempt to create or share content that could mislead or deceive others, including for example creation of disinformation, content enabling fraud, or deceptive impersonation.
- Not to infringe on the rights of others. Do not attempt to use the Online Services to infringe on others' legal rights, including intellectual property rights.
- Not to use the service to create or share inappropriate content or material. Bing does not permit the use of the Online Services to create or share adult content, violence or gore, hateful content, terrorism and violent extremist content, glorification of violence, child sexual exploitation or abuse material, or content that is otherwise disturbing or offensive.

Content and Moderation
Access Restriction and User Appeal
If you feel your use of AI powered experiences in Bing has been restricted in error, you may ask Bing to reevaluate its decision to suspend access. To appeal a decision to restrict access to these experiences, please submit a request using Microsoft's Report a Concern to Bing form outlining what you think we got wrong and why. While we encourage the use of Bing's new AI powered experiences, we reserve the right to ensure these tools are not abused.
Copilot AI Experiences Terms
- Eligibility and Use Requirements. Your use of the Online Services is governed by these terms (this "Agreement"), the Microsoft Services Agreement, as well as the Image Creator from Designer Terms (to the extent applicable) which are both incorporated by reference. You agree that the Online Services constitute a Service, as defined in the Microsoft Services Agreement. If there is any conflict between this Agreement, the Microsoft Services Agreement, and the Image Creator from Designer Terms, the conflicting provision in this Agreement will control.
Your use of the Online Services is also subject to the Microsoft Privacy Statement, which describes our collection, use and disclosure of information relating to your use of the Online Services.
Unauthenticated users may be given limited access to the Conversational Experiences. Microsoft will have the right in its sole discretion to allow use of the Online Services, however Microsoft so determines. - Using the Online Services. However, by using the Online Services, posting, uploading, inputting, providing or submitting content you are granting Microsoft, its affiliated companies and third party partners permission to use the Prompts, Creations, customizations (including GPTs) , and related content in connection with the operation of its businesses (including, without limitation, all Microsoft Services), including, without limitation, the license rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat the Prompts, Creations, and other content you provide; and the right to sublicense such rights to any supplier of the Online Services. Your use of the Online Services does not grant you any ownership rights in any underlying technologies, intellectual property, or other data that comprise or support the Online Services.
No compensation will be paid with respect to the use of your content, as provided herein. Microsoft is under no obligation to post or use any content you may provide, and Microsoft may remove any content at any time in its sole discretion.

You are solely responsible for your interactions with Plugins which may be independently developed by third parties not affiliated with Microsoft. Unless we otherwise determine, you must manually enable each Plugin and you may interact with up to the maximum number of Plugins that we determine at a time from within the Online Services. You should not enable a Plugin unless you know and trust the underlying application and you have reviewed the applicable Terms of Use and privacy policy.
Your use of Plugins may expose you to content you find offensive, inappropriate, or objectionable. Microsoft, in its sole discretion, may review or remove Plugins from the Online Services.
When you interact with an enabled Plugin, the Online Services will share relevant parts of your Content and other necessary details (which could include some location information) ("Plugin Data") to the Plugin. By enabling a Plugin, you authorize us to send your Plugin Data to the relevant third-party, which will handle it according to its terms. We are not responsible for Plugin Data after it has been sent to a Plugin that we do not own. The Plugin will process your request and return information and content ("Plugin Output") via the Online Services. The information and content included in the Plugin Output is not owned by you or Microsoft, and may be subject to the terms of the Plugin. - Custom GPTs. Copilot may include customized versions of the Conversational Experiences ("Custom GPTs"), created using instructions, prompts, data, and information provided by third parties ("Third Party GPTs"). Microsoft may also offer customized versions of Conversational Experiences created by Microsoft. Unless a Custom GPT is expressly identified as a Microsoft product, that Custom GPT may have been created by a third party and may incorporate third party content, instructions, or data that is not owned or controlled by Microsoft. You may find information about the creator of a Custom GPT under the name of every Custom GPT. Third Party GPTs created by other users may be shared with you. You should only open and use Third Party GPTs from sources you trust. You are solely responsible for your interactions with Third Party GPTs, which may be independently developed by third parties not affiliated with Microsoft. Your use of Third Party GPTs may expose you to content you find offensive, inappropriate, or objectionable. If you encounter a Third Party GPT or content generated from a Third Party GPT that violates this Agreement or the Code of Conduct, please submit a report using the Report a Concern Form. Third Party GPTs may contain advertising. Microsoft may remove, suspend, or disable access to Third Party GPTs at any time without prior notice, and users may remove or delete their Third Party GPTs at any time without prior notice.

Copilot Pro
- Custom GPT Builder. Copilot Pro subscribers may create Custom GPTs using the custom GPT builder feature. All information (including the GPT name and description), instructions, knowledge, documents, and data that you provide to create a Custom GPT must comply with the Code of Conduct and shall not infringe, facilitate, or promote the infringement of any third party right (including copyright, trademark, and publicity rights) or any illegal or harmful activity. You may not imply that Microsoft, any of its affiliates, or its third-party partners created, endorsed, or approved your Custom GPT. You may not make misleading or false statements concerning the development, endorsement, affiliation, or creation of a Custom GPT. You may not create Custom GPTs primarily targeted toward minor children or intended to appeal primarily to minor children. You are responsible for ensuring that your Custom GPT complies with these Terms and the Code of Conduct.
Microsoft, in its sole discretion, may review, suspend, block publication, limit access, remove, or terminate access to GPTs you create at any time without notice to you based on your breach of this Agreement (including failure to comply with the Code of Conduct), if we suspect you are engaged in fraudulent or illegal activity, or if your Microsoft account is suspended or closed by us or by you. You may appeal such decisions as set forth below in the "Access Restriction and User Appeal" section of these Terms. Custom GPTs may contain third party advertising. You will not be remunerated or owed any compensation for any such advertising that may appear in Custom GPTs. If you elect to share your Custom GPT, the name associated with your Microsoft account as well as any sensitive or personal data or other information, data, or documents you upload or input to your GPT may be publicly available or shared with recipients of your GPT link, Microsoft affiliates and/or third-party partners.

Copilot AI Experiences Terms

Your use of the Online Services is governed by these terms (this "Agreement"), the Microsoft Services Agreement, as well as the Image Creator from Designer Terms (to the extent applicable) which are both incorporated by reference. You agree that the Online Services constitute a Service, as defined in the Microsoft Services Agreement. If there is any conflict between this Agreement, the Microsoft Services Agreement, and the Image Creator from Designer Terms, the conflicting provision in this Agreement will control.
Your use of the Online Services is also subject to the Microsoft Privacy Statement, which describes our collection, use and disclosure of information relating to your use of the Online Services.
Unauthenticated users may be given limited access to the Conversational Experiences. Microsoft will have the right in its sole discretion to allow use of the Online Services, however Microsoft so determines. - Using the Online Services. The Conversational Experiences allow you to submit inputs ("Prompts") and converse with an online computer-powered chatbot and in certain circumstances generate text content ("Creations"). Your use of the Online Services must comply with the Online Services Code of Conduct ("Code of Conduct"). By using the Online Services you are affirming that you have read the Terms of Use and Code of Conduct, understand them, and abide by them.
You must use the Online Services and the generated Creations only: (i) in a lawful manner and in compliance with all applicable laws; (ii) in accordance with this Agreement, the Code of Conduct, and Microsoft Services Agreement documentation directed to the Online Services; and (iii) in a manner that does not infringe or attempt to infringe, misappropriate or otherwise violate any of our rights or those of any other person or entity (for clarity, "manner" includes without limitation the method, purpose and/or means of causing or attempting to cause the Online Services to generate content).
Due to the nature of the Online Services, Creations may not be unique across users and the Online Services may generate the same or similar output for Microsoft or other users. Other users may also ask similar questions and receive the same, similar or different responses.
These Online Services, including machine to human conversational interactions, may include advertising.
The Online Services may include both automated and manual (human) processing of data. You should not enter or upload any data you would not want reviewed.

- Suspension and Cancellation. Subject to the requirements of law, we may limit, suspend, or terminate your use of any of the Online Services at any time without notice and for any reason, including (without limitation) if you breach this Agreement (including by failing to comply with the Code of Conduct), if we suspect you are engaged in fraudulent or illegal activity, or if your Microsoft account is suspended or closed by us or by you.
- Ownership of Content. Microsoft does not claim ownership of Prompts, Creations, customizations, instructions, or any other content you provide, post, input, or submit to, or receive from, the Online Services (including feedback and suggestions). However, by using the Online Services, posting, uploading, inputting, providing or submitting content you are granting Microsoft, its affiliated companies and third party partners permission to use the Prompts, Creations, customizations, and related content in connection with the operation of its businesses (including, without limitation, all Microsoft Services), including, without limitation, the license rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat the Prompts, Creations, and other content you provide; and the right to sublicense such rights to any supplier of the Online Services. No compensation will be paid with respect to the use of your content, as provided herein. Microsoft is under no obligation to post or use any content you may provide, and Microsoft may remove any content at any time in its sole discretion.
You warrant and represent that you own or otherwise control all of the rights to your content as described in these Terms including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the content. - No Guarantees; No Representations or Warranties; Indemnification by You. We plan to continue to develop and improve the Online Services, but we make no guarantees or promises about how the Online Services operate or that they will function as intended. We may limit the speed of the Online Services at times as we determine. We may add or remove features as we determine. The Online Services are for entertainment purposes; the Online Services are not error-free, may not work as expected and may generate incorrect information. You should not rely on the Online Services, and you should not use the Online Services for advice of any kind. Your use of the Online Services is at your own risk.
Without limiting Section 12 of the Microsoft Services Agreement in any way, but for the sake of clarity, Microsoft does not make any warranty or representation of any kind that any material created by the Online Services does not infringe the rights of any third party in any subsequent use of the content you may use (including but not limited to copyright, trademark, rights of privacy and publicity, and defamation). You must use any content from the Online Services in accordance with the Code of Conduct and applicable law and subject to any third-party rights. In addition, you agree to indemnify and hold harmless Microsoft, its affiliates, employees and any other agents from and against any claims, losses, and expenses (including attorneys' fees) arising from or relating to your use of the Online Services, including your subsequent use of any content from the Online Services and your breach of these Terms, the Microsoft Services Agreement, the Code of Conduct or violation of applicable law. - Plugins. Enabling Plugins will allow you to interact with other applications or websites while using the Online Services. Unless we otherwise determine, you must manually enable each Plugin and you may interact with up to the maximum number of Plugins that we determine at a time from within the Online Services. You should not enable a Plugin unless you know and trust the underlying application and you have reviewed the applicable Terms of Use and privacy policy.
Your use of Plugins may expose you to content you find offensive, inappropriate, or objectionable. Microsoft, in its sole discretion, may review or remove Plugins from the Online Services.
When you interact with an enabled Plugin, the Online Services will share relevant parts of your Content and other necessary details (which could include some location information) ("Plugin Data") to the Plugin. By enabling a Plugin, you authorize us to send your Plugin Data to the relevant third-party, which will handle it according to its terms. We are not responsible for Plugin Data after it has been sent to a Plugin that we do not own. The Plugin will process your request and return information and content ("Plugin Output") via the Online Services. If you are a Copilot Pro subscriber your use of the Online Services is governed by this Agreement, the Microsoft Services Agreement, and the Image Creator Terms as described in paragraph 1. For example, Microsoft 365 Family or Microsoft 365 Personal subscriptions are separately licensed under the terms at https://www.microsoft.com/useterms. WHEN & WHERE THESE TERMS APPLY
These Terms apply to your use of “Copilot,” which includes:
- The standalone Copilot apps on your computer or mobile device
- The Copilot service we offer at copilot.microsoft.com, copilot.com, and copilot.ai
- Conversations you have with Copilot through other Microsoft apps and websites
- Conversations you have with Copilot through third-party apps and platforms
- Other Copilot-branded apps and services that link to these Terms
These Terms don’t apply to Microsoft 365 Copilot apps or services unless that specific app or service says that these Terms apply.
DEFINITIONS
Certain words and phrases we use in these Terms have a particular meaning:
- Words like “you”, “your” and “yours” mean you, the person accessing and using Copilot.
- Words like “we”, “us”, and “our” means Microsoft, the company that offers Copilot, as well as the related companies we own or control and the companies and people that work on our behalf.
- A “Prompt” is the content – text, audio, images, files, voice, or video – that you send to or share with Copilot.
- A “Response” is the content that Copilot sends to or shares with you. Some Responses might include “Creations” – original content or works of art that Copilot creates in response to your Prompts.
- “Your Content” means the Prompts and Responses that are part of your conversations with Copilot, but it doesn’t include any content we separately own (like Xbox gaming clips, for example).
- “Actions” refers to the automated set of tasks that Copilot takes on your behalf at your request.
- “Services” is defined in the Microsoft Services Agreement. Copilot is a Service under that Agreement.
WHO CAN USE COPILOT
You need to be old enough to use Copilot – usually at least 13, but sometimes 18 or older, depending on your country’s laws. Because laws vary by country, Copilot isn’t available everywhere.
If you’re under 18, or if you use Copilot without logging in, we might turn off or limit some features for legal or safety reasons. If we ask for your birthday and country when you sign up or log in, you must give us your real information.
Don’t use tools or computer programs (like bots or scrapers) to access Copilot. You can only use Copilot for your own personal use.
HOW YOU USE COPILOT
Copilot is an AI-powered conversational service. Copilot will generate Responses to Prompts you submit and may also offer you Responses directly in your ongoing conversations or for things you have asked Copilot to remember.
Copilot tries to give you good answers, but it can make mistakes. Sometimes, the sources Copilot uses may not be reliable, relevant, or accurate, and sometimes, Copilot may give you wrong information. When responding, Copilot may use information it finds on the internet, and we don’t control that content. You might see Responses that seem convincing but are incomplete, inaccurate, or inappropriate.
Always use your judgment and check the information you get from Copilot before you make decisions or act. If you see something wrong or inappropriate from Copilot, use the Report or Feedback features in Copilot to let us know. If you have a legal concern about something Copilot says, please use the Report a Concern page to tell us.
Because of the way Copilot works, the Responses you get from Copilot may not be unique to you. Copilot may give the same or similar Responses and Creations to Microsoft, or to other people. Other people may send similar Prompts as yours, and they could get the same, similar, or different Responses and Creations.
By using Copilot, you’re telling us that:
- You’ve read, understood, and agree to these Terms, and will abide by the Code of Conduct (below).
- You’ll use Copilot only in lawful ways and in compliance with all applicable laws.
- You won’t use Copilot to violate our or anyone else’s rights.
CODE OF CONDUCT
When you use Copilot, you must follow the general Code of Conduct set out in the Microsoft Services Agreement. As applied to Copilot, this means:
- Don’t use Copilot to harm yourself or others. Don’t use Copilot to help harass, bully, abuse, threaten, or intimidate other people, or otherwise harm others. Don’t use Copilot to help exploit others based on age, disability, or social or economic situations.
- Don’t damage our ability to provide Copilot to you and others. Don’t use bots or scrapers, and don’t engage in technical attacks, excess usage, prompt-based manipulation, “jailbreaking”, and other abuses.
- Don’t violate the privacy of others. Don’t use Copilot to help violate the privacy of others, including sharing their private information (e.g. “doxing”). Don’t use Copilot to infer sensitive information about others, like a person's race, political opinions, trade union membership, religious or philosophical beliefs, sex life, or sexual orientation. Don’t share or capture images, video, audio, or other content that includes other people without their consent, and don’t try to use Copilot to process someone else’s biometric identifiers or information.
- Don’t use Copilot to trick, lie to, or cheat others. Don’t use Copilot to help mislead or deceive people. Don’t use Copilot to create or share disinformation or content that will be used to impersonate, defraud, or deceive others.
- Don’t infringe the rights of others. Don’t use Copilot to infringe on other people’s legal rights, including their intellectual property and publicity rights.
- Don’t create or share inappropriate content or material. Don’t use Copilot to create or share adult content, violence or gore, hateful content, terrorism and violent extremist content, glorification of violence or suicide, child sexual exploitation or abuse material, or content that is otherwise disturbing or offensive. Don’t use Copilot to create or edit images, voice, or video of other people (e.g. “deepfakes”) without their permission.
- Don’t do anything illegal. Don’t use Copilot to break the law, or to help or encourage others to break the law.
If you see something wrong or inappropriate from Copilot, use the Report or Feedback features in Copilot to let us know. If you have a legal concern about something Copilot says, please use the Report a Concern page to tell us.
We may block, restrict, or remove your Prompts or other content from you that violates these Terms, or that could lead Copilot to create a Response that violates these Terms.
OUR DECISIONS ABOUT COPILOT
We may choose to limit or stop offering or supporting Copilot or any feature within Copilot at any time and for any reason.
Unless prohibited by law, we may limit, suspend, or permanently revoke your access to or use of Copilot (and potentially all other Services) in our sole discretion, at any time and without notice. Some of the reasons we might do this, for example, is if you breach these Terms or violate the Code of Conduct, if we suspect you’re engaged in fraudulent or illegal activity, or if your Microsoft Account or the account you use to log in to Copilot is suspended or closed. If you feel your access has been restricted by mistake, you may ask us to reevaluate our decision by submitting a request using the Report a Concern form outlining what you think we got wrong and why.
SHOPPING EXPERIENCES
Depending on your location and other factors, we may offer you the opportunity to browse, shop and buy certain products through Copilot. If you use Copilot to buy something, it’s sold and shipped by a third party (“Merchant”), not by us. We don’t process payments for your purchases through Copilot.
- Anything you buy with Copilot is subject to the Merchant’s terms and conditions (including pricing, fees, and shipping, cancellation, and refund policies). You are responsible for reading and complying with the Merchant’s terms that apply to your purchase, including how the Merchant collects and uses your personal information under its privacy policy.
- We aren’t responsible or liable for any dispute between you and the Merchant about your purchase. If you have any disputes or questions about any product you purchase through Copilot, you must address it directly with the Merchant. If you have disputes or questions about your payment for the product, you must address it with your payment issuer, bank, or wallet provider.
- We collect, store, use, and share your personal information, including your payment information and purchases you make, in accordance with the Microsoft Privacy Statement. You authorize each Merchant to share with us information about you and your purchase, and for us to send information (including your personal information and transaction details) to the Merchant, the Merchant’s payment processor, our payment processor, or other third party necessary to complete your purchase.
IMPORTANT DISCLOSURES & WARNINGS
- Copilot may include advertising.
- Copilot may include both automated and manual (human) processing of data. You shouldn’t share any information with Copilot that you don’t want us to review.
- We plan to continue to develop and improve Copilot, but we make no guarantees or promises about how Copilot will operate or that it will operate as intended.
- Sometimes, we may offer certain features or services as part of “Copilot Labs.” These features and services are highly experimental and may not always work as intended. We may add, modify, or remove features or services from Copilot Labs at any time for any reason.
- We may limit the speed or performance of Copilot as we think necessary.
- When you request that Copilot take Actions on your behalf, you are solely responsible for those Actions and any results or consequences.
- Copilot is for entertainment purposes only. It can make mistakes, and it may not work as intended. Don’t rely on Copilot for important advice. Use Copilot at your own risk.
- WITHOUT LIMITING SECTION 12 OF THE MICROSOFT SERVICES AGREEMENT IN ANY WAY, BUT FOR THE SAKE OF CLARITY, WE DO NOT MAKE ANY WARRANTY OR REPRESENTATION OF ANY KIND ABOUT COPILOT. For example, we can’t promise that any Copilot’s Responses won’t infringe someone else’s rights (like their copyrights, trademarks, or rights of privacy) or defame them. You are solely responsible if you choose to publish or share Copilot’s Responses publicly or with any other person.
- You agree to indemnify us and hold us harmless (including our affiliates, employees and any other agents) from and against any claims, losses, and expenses (including attorneys' fees) arising from or relating to your use of Copilot, including without limitation your use, sharing, or publication of any Prompt, Responses, or Creations, or your breach of these Terms or violation of applicable law.
- You may stop using Copilot at any time. If you want to close your Microsoft Account, please see the Microsoft Services Agreement.
OWNERSHIP OF CONTENT
We don’t own Your Content, but we may use Your Content to operate Copilot and improve it. By using Copilot, you grant us permission to use Your Content, which means we can copy, distribute, transmit, publicly display, publicly perform, edit, translate, and reformat it, and we can give those same rights to others who work on our behalf.
We get to decide whether to use Your Content, and we don’t have to pay you, ask your permission, or tell you when we do. But that doesn’t mean we can use it however we want. The Microsoft Privacy Statement explains how we use Your Content, and the privacy options in Copilot give you control over some of those uses.
We can decide to remove or stop using Your Content at any time for any reason. By sharing Your Content with Copilot, you promise us that you have all rights to Your Content and that if we use Your Content, we won’t be violating someone else’s rights.
Although our Terms grant you permission to use Copilot, we are not granting you any rights in the underlying technology, intellectual property, or data that makes up Copilot.
OTHER TERMS & AGREEMENTS
- By agreeing to these Terms, you’re also agreeing to the Microsoft Services Agreement, a legal agreement between you and us that applies to your use of our Services (including Copilot). If you have a Microsoft account, you already agreed to the Microsoft Services Agreement when you first created a Microsoft account.
Even if you don’t have a Microsoft Account – for example, if you’re using Copilot without logging in, or if you log in to Copilot using a non-Microsoft account – you’re still agreeing to the Microsoft Services Agreement by using Copilot. Please make sure you review it carefully. - If you use Copilot to create images, you’re also agreeing to the Image Creator Terms.
- If you use Gaming Copilot or other AI-powered experiences provided in connection with any Xbox Services, you are also subject to the Xbox Community Standards.
- Copilot may be integrated into other products and services we separately license to you. For example, Microsoft 365 Family or Microsoft 365 Personal subscriptions are separately licensed under the terms at https://www.microsoft.com/useterms.
- If any of the language in those other agreements conflicts with the language in these Terms, the language in these Terms controls.
- When you use Copilot, you are subject to the Microsoft Privacy Statement, which describes how we collect, use, and share information relating to your use of Copilot.
UPDATES TO THESE TERMS
From time to time, we might need to update these Terms for different reasons. Some of those reasons might include adding new features, complying with changing laws, addressing security, safety, or fraud issues, or making our Terms clearer and easier to understand.
There may be rare circumstances where we need to update these Terms immediately. Otherwise, we’ll post the updated Terms to this page at least 30 days before they take effect. We’ll also include the date the terms take effect at the top of the page, so you can easily tell when we’ve made an update.
If you keep using Copilot after the updates take effect, you’re agreeing to those updates. If you don’t agree to the updates, you must stop using Copilot.
