Microsoft Demonstration Competition 2008 (‘Demo Comp’) – Terms & Conditions

  1. Instructions on how to enter and nominate forms part of the conditions of entry. By participating entrants agree to be bound by these conditions.
  2. The promoter is Microsoft Pty Limited, ACN 002 589 460 of 1 Epping Road, North Ryde, New South Wales, 2113.
  3. Entry is open to Australian residents: (a) aged 18 years or over; or (b) who will be aged 18 years or over on or before 1st September 2008. Employees and their immediate families of the promoter, its retailers, suppliers and associated companies and agencies are not eligible to enter.
  4. The competition commences at 12:00am (Sydney time) 1st April 2008 and closes at 11.59pm (Sydney time) on 31st July 2008.
  5. To be classed as a valid demo, each entry must meet ALL of the following requirements.
    • Showcase (as the focus of the demo entry) at least one of the following Microsoft® Technologies: Windows Server® 2008, Visual Studio® 2008 or SQL Server® 2008.
    • Is an original work not previously published or displayed in any media or forum anywhere in the world.
    • Is no longer than 10 minutes in duration including any credits.
    • Is videoed, either through live recording of the demo, or using demonstration screencast technologies. The allowable demonstration technologies include, but are not limited to, Camtasia™ (TechSmith Corporation) and DemoMate™ (Morse Best Innovation, Inc)
  6. The entrant makes the following warranties to the promoter.
    • The video demo or screencast has been specifically made for this competition and is an original work which has not been previously published or displayed in any media or forum anywhere in the world.
    • The entrant recorded the demo video or screencast or has obtained express consent from the person who recorded the demo video or screencast to submit the demo video or screencast into this competition.
    • The entrant consents and has obtained express consent from the person who recorded the demo video or screencast for the promoter to use the entry for the purposes of this competition and for future promotional purposes.
    • Any person appearing in the demo video or screencast has granted express permission for the recording of their image(s) to be used in the entry and submitted by the entrant for the purposes of this competition.
    • The entrant consents and has obtained consents from any person(s) appearing in the demo video or screencast (if applicable) for the promoter to do any act or omission in relation to the demo video or screencast for the purposes of this competition and for future promotional purposes, including any act or omission that might otherwise infringe the entrant's or any third party's moral rights.
    • The promoter will not breach any third party rights (including moral rights) when using the video demo or screencast for the purposes of this competition and for future promotional purposes.
  7. The registration process will require entrants to do the following.
    • Post their valid demo entry video or screencast online at http://silverlight.live.com/. Entrants will be required to have a Windows Live™ ID to complete this part of the registration process. Each entry will be required to comply with any requirements of the website http://silverlight.live.com/ to upload the entry.
    • Complete a registration form at www.microsoft.com.au/heroes/community. The registration form will require entrants to provide details of their Australian State of residence, community (or user) group, demo topic, name and contact details.
  8. If an entry progresses to a further stage in the competition, entrants consent to the promoter contacting them with information regarding their continued involvement with the competition.
  9. Multiple entries are accepted subject to each entry being an original demo video or screencast.
  10. All entries are deemed to be received at the time of receipt into the promotion database and not at the time of transmission by the entrant. Any costs associated with entering the competition and accessing the website are the responsibility of the entrant.
  11. The promoter reserves the right to verify the validity of entries (including proof of Australian residence of each entrant) and to disqualify any entrant who the promoter believes either has tampered with the entry process or has submitted an entry that is not in accordance with these conditions of entry.
  12. State Finalists (from Nominated State Finalists or Wildcard State Finalists) will be determined by one of the following methods.
    • By 11.59pm (Sydney time) 31st July 2008, a community leader of a community group (who meets the eligibility requirement) must nominate one entrant to proceed to the State Final. A community leader is permitted to nominate his/her entry. Judging guidelines for the purposes of nomination will be made available to community groups. Details of the nomination including entrants name, email, demo topic and link to valid demo entry must be sent to ozhero08@microsoft.com to ensure entry into the State Final. The nominated entrants will receive entry into the State Final subject to compliance with the entry guidelines (conditions 5, 6 and 7) (Nominated State Finalists). For a community leader to be eligible to nominate a State finalist, a minimum of 3 valid demo video entries or screencasts from at least 2 different people within the leader’s community group must be submitted. If this eligibility requirement is not met, the community leader will not be eligible to nominate a State finalist; in which case the entries will only be judged in the Wildcard entries of this competition. The promoter may, in its absolute discretion, verify that a community leader is validly registered on the promoter’s influencer program, and is entitled to nominate an entrant.
    • All valid entries not nominated by a community group leader will be judged by the promoter against the entry and judging guidelines for originality and creativity. Judging will take place throughout the competition period. This is a game of skill and chance plays no part in determining the selection of finalists or winners. The promoter may, in its absolute discretion, choose up to 30 wildcard entries nationally to proceed to a State Final (Wildcard State Finalists). These Wildcard State Finalists will be notified through the email submitted in their registration form by 7th August 2008.
  13. All valid Nominated State Finalists received by the closing date and any Wildcard State Finalists will be required to present their demo entry to a live audience at a State Final (in the entrants’ State of residence supplied on the registration form). If a State Finalist resides in Tasmania or the Northern Territory, then he/she will be required to organise their interstate travel to/from and accommodation (if necessary) a State Final venue listed in Condition 14. State Finalists will only receive their State Finalist Prize if they present their demo entry at a State Final. State Finals will be held at the Microsoft office in the States listed in Condition 14. Any costs or expenses incurred by an entrant for the purposes of attending a State Final venue will be at the entrants’ own expense including any travel or accommodation costs (if required).
  14. State Finals will be held at the Microsoft office at a time to be determined by the promoter in each of the following States (dates are subject to change, and State Finalists will be notified of any date changes).
    • Sydney - 11th August 2008
    • Canberra - 12th August 2008
    • Melbourne - 14th August 2008
    • Brisbane - 18th August 2008
    • Adelaide- 20th August 2008
    • Perth - 21st August 2008
  15. Each entry will be individually judged based on originality and creativity. One winning entry from each State Final will progress to the National Final (National Finalist).
  16. The National Final will be held at Australia TechEd 2008 in Sydney from 3rd – 5th September 2008 at the Sydney Convention and Exhibition Centre. All National Finalists will be required to attend the National Final in order to be in the running to win the National Prize.
  17. Prizes are as follows.
    State Finalist Prize – awarded to Nominated State Finalists and Wildcard State Finalists who present their demo entry at a State Final
    1 x Microsoft Wireless Notebook Presenter Mouse 8000 valued at $78 RRP
    1 x 1GB USB Flash Drive valued at $19.95 RRP
    1 x Demo Comp Polo T-Shirt valued at $25 RRP
    Maximum State Finalist Prize value per entrant: $123 RRP

    State Winners Prize
    State Winner Prizes will be awarded to the winner in each State Final venue (NSW, QLD, WA, SA, VIC and ACT) (State Winner). NT and TAS finalists are eligible to win a State Winners prize subject to them presenting their demo video at one of the State Final venue(s); their entries will then be judged together with the State Finalists from that State. Total number of prizes is 6.

    1 x Ticket to TechEd 2008 Sydney from 3rd – 5th September 2008 at the Sydney Convention and Exhibition Centre

    Winners will receive economy class airfares to Sydney from their nearest Australian capital city (NSW winner excluded), arriving in Sydney on 2nd September 2008 and departing Sydney on 5th September 2008. Package includes 3 nights accommodation at a location chosen by the promoter, a ticket to TechEd Sydney 2008 and airport transfers to and from the accommodation in Sydney (if required). Travel can only be made at this time nominated by the promoter to ensure attendance at the National Final. If the State winner cannot attend TechEd 2008 (or the Event is cancelled for whatever reason) at the time required, they will forfeit their prize and it will be at the promoter’s discretion whether the State Winner’s Prize will be awarded to another participant (or in the case of cancellation, an alternative prize will be awarded). State Winner Prize valued at maximum $3500 (based on travels from Perth).

    RRP National Winner’s Prize

    National Winner will receive economy class airfares from their nearest Australian capital city to Los Angeles, United States. The winner will be responsible for ensuring that he or she has the necessary Visa for entry into the United States (if required). Package includes 5 nights accommodation at a location chosen by the promoter, one ticket to US TechEd 2009 (either TechEd IT Professional or TechEd Developer Event) in Los Angeles and airport transfers to and from the accommodation in Los Angeles. Travel can only be made at the time nominated by the promoter to ensure attendance at the TechEd Event. If the National Winner cannot attend US TechEd 2009 (or the Event is cancelled for whatever reason) at the time required, they will forfeit their prize and it will be at the promoter’s discretion whether the National Winner’s Prize will be awarded to another participant (or in the case of cancellation, an alternative prize will be awarded). Maximum prize value is AUD $6000.

  18. Travel arrangements are at the promoter’s discretion and dependent on the prize winner’s nearest Australian capital airport. Winners must be able to travel on the dates nominated by the promoter. All meals, beverages, extra activities, spending money and all other ancillary costs (including travel insurance, visa requirements) not expressly provided, as well as obtaining any of these, are the responsibility of the winner. In the event that, for any reason whatsoever, the prize winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the prize winner and cash will not be awarded in lieu of that element of the prize.
  19. Before the State Winners prizes or National Winner’s prize are awarded, the winner will be required to sign a form to release the promoter from and indemnify the promoter against, any and all liability arising from the use or participation in the prize.
  20. Travel prizes are subject to flight and booking availability. Prizes are not exchangeable, transferable or redeemable for cash. If the promoter is unable to supply the nominated prize, the promoter reserves the right to supply another prize of greater or equal value.
  21. The stated prize value is the recommended retail value (including GST) in Australia as provided by the supplier and is correct at the time of printing. The promoter accepts no responsibility for any variation in the value of the prize. The promoter and its associated agencies and companies accept no responsibility for prizes damaged or lost in transit.
  22. In consideration of the promoter judging your entry for selection as a finalist or winner, you grant a non-exclusive license throughout the world, in all media now existing or subsequently devised, in perpetuity to the promoter (whether or not your entry is selected as a finalist or winner) for the promoter to do any and all of the acts now or subsequently comprising the copyright (and all other intellectual property rights) in the demo video or screencast for the purposes of conducting this competition and for future promotional purposes without any further compensation to you.
  23. The promoter’s decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the promoter. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way.
  24. State Winners will be announced at the time of the State Final and the National Winner will be announced at the National Final to be held at Australia TechEd 2008.
  25. The promoter assumes no responsibility for, and the entrant releases the promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the entrant’s participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an entrant’s error, any technical problem of any kind including communications or network failure, unauthorised access to, transferring or theft of data, whether caused by the entrant or associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotion’s administration, security, fairness or integrity are compromised or affected, the promoter may cancel, terminate, modify or suspend the promotion and/or disqualify any entrant involved in interfering or tampering with the conduct of this promotion in any way.
  26. Subject to any applicable law which cannot be excluded, the promoter and its related bodies corporate shall not be liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss of profits or loss arising from negligence) arising directly or indirectly out of or in connection with the promotion or any prize.
  27. Tax implications may arise from the prize winnings. Independent financial advice should be sought.
  28. Details from all entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for publicity purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described. Entrants may access and/or change their data by following the procedures in the promoter’s privacy policy which is available at www.microsoft.com/australia/privacy. The promoter will only use your personal details for marketing purposes outside those described above if you “opt in” to join the mailing list when prompted.
