Summary of Changes

Below is a summary of changes and updates made to the terms since June 2020.

October 5, 2021

Updates to support the launch of Windows 11. Note that Windows 11 will be available to purchase on VL price lists starting November 1.

October 1, 2021

Audio Services: Added terms for Operator Connect.

Microsoft 365: Added new offers, Microsoft Viva Insights and Privacy Management to the Availability Table for the applicable Programs. Updated License Prerequisites table with Viva Insights and Privacy Management. Added Service Specific Terms for Viva Insights that describes credit expiration, and Privacy Management that describes Data Subject Requests.

Microsoft Azure: The Azure terms have been consolidated from four separate sections (formerly Microsoft Azure User Plans, Infrastructure Plans, Support Plans, and Azure Services) into a single Microsoft Azure section. For more details see https://www.microsoft.com/en-us/licensing/news/updates-to-azure-product-terms. Added terms for Multi-Cloud Scanning Connectors for Azure Purview.

Office Applications: Updated terms to support launch of Office LTSC 2021 Suites and Applications (for Windows and Mac). There are no changes to the Availability, Use Rights, License Model or Software Assurance terms outside of updated version details.

Privacy & Security Terms: Corrected the Microsoft Azure Core Services list for “Azure Search” which was renamed to “Azure Cognitive Search” in October 2019. Added Azure Event Grid and Azure Purview as Core Online Services.

Professional Services: Added Microsoft Unified Support terms and availability; Updated Premier Support terms and availability; Added Microsoft Enhanced Services and Solution terms and availability; Modified the Microsoft Support Services Business Rules terms to reflect the current support services terms.

Promotions: The Power Apps Promotion for EA, EAS, and CSP Customers has been expired and removed from the list of promotions. The Power Apps Per App offer is now generally available to all EA, EAS, EES and CSP customers. Extended promotional offer period for Free Audio Conferencing for EA/EAS/EES Customers and Free Audio Conferencing for EA/EAS/EES Customers from December 31, 2021, until May 31, 2022.

September 15, 2021

A new version of the Data Protection Addendum, the Microsoft Products and Services Data Protection Addendum has been published (formerly called the Microsoft Online Services Data Protection Addendum). The DPA may be downloaded here https://aka.ms/DPA. To accommodate the new version of the DPA, several updates have been made to the Product Terms. These updates include:

September 1, 2020

Azure Services: Added “API Terms for Security & Compliance Applications” to the service specific terms. Added Azure Virtual Desktop conditions stating that the Azure Virtual Desktop control plane may only be used to manage Azure Virtual Desktop VMs running on Azure, and Windows 10 Enterprise multi-session is limited for use on Azure Virtual Desktop VMs running on Azure only.

Glossary: Added a statement that terms defined in the Glossary apply unless otherwise defined in product specific terms, as some product entries contain additional defined terms. 

Universal License Terms for Online Services: Added language to the Universal License Terms for Online Services to state and clarify eligibility requirements for customers to purchase online services step-up licenses. 

Windows Desktop Operating System: Removed Get Genuine licenses from availability table for MCA as they have been removed from the price list.

Windows Server Standard, Datacenter and Essentials: Updated entry for Windows Server 2022 launch. There are no changes to the license terms for Windows Server for this launch.

Online Services Privacy & Security Terms: Added Azure Time Series Insights to the list of Microsoft Azure Core Services.

Microsoft Dynamics 365 Services: Added Dynamics 365 Intelligent Order Management and Dynamics 365 Marketing Additional Interactions Tiers 1-5 offers to the Availability Table for applicable programs. Updated Purchasing Minimum – All Programs table to include minimum purchasing details for Dynamics 365 Marketing Additional Interactions Tiers.

Microsoft 365: Updated terms for Microsoft 365 Education A1 making Windows 7/8/8.1/10 Home a qualifying upgrade for the Windows 10 Pro Education software included with Microsoft 365 Education A1.

Windows Desktop Operating System: Added HEVC Codec (Per Device) to the availability table (EA/EAS only).

Windows 365: Added terms for the Windows 365 offer.

July 30, 2021

Microsoft Azure Services: Added terms for the Azure Arc enabled SQL Managed Instance offer. This includes new Service Specific Terms for Azure Arc enabled SQL Managed Instance and updates to the Azure Hybrid Benefit terms to support it.

Microsoft Azure Services: Added terms for the Azure Virtual Desktop Per User Access offer.

Promotions: Added terms for the Azure Virtual Desktop Per User Access pricing promotion.

Windows Desktop Operating System: Added terms for the Windows diagnostic data processor configuration in the Use Rights section.

Microsoft Azure Services: Updated Azure Communication Services terms to include clauses for License Terms Precedence (to address previews), Defense of Claims and Messaging Policy terms. Updated all instances of Windows Virtual Desktop (and/or WVD) to Azure Virtual Desktop corresponding to updated branding.

Microsoft 365: Added terms for the new Education Insights Premium offer, including license coverage requirements and license prerequisites.

Microsoft Dynamics 365 Services: Added terms for PSTN Services provided in Dynamics 365 services via Azure Communication Services. Added a clause for Azure availability covering Dynamics 365 services available for purchase as an Azure meter. Updated the add-ons table.

Microsoft Power Platform: Added terms for Professional Direct Support offer.

Online Services Privacy & Security Terms: Added statement that the Online Services Privacy & Security Terms are formerly contained in Attachment 1 to the Online Services Terms for reference purposes. Added Azure App Configuration to the list of Microsoft Azure Core Services.

Windows Desktop Operating System: Updated all instances of Windows Virtual Desktop (and/or WVD) to Azure Virtual Desktop. Clarified Windows 10 entitlements that allow users to access Windows desktops on Azure VMs or Azure Virtual Desktops are entitlements for Customers’ own tenants. Added a clause for the new Get Genuine offer in CSP/Microsoft Customer Agreement.

June 1, 2021

General: For customers who choose to purchase “From SA” licenses, we removed the requirement that customer retain the corresponding Qualifying Licenses throughout its From SA license subscription period. All other terms and restrictions in the agreement continue to apply.

Microsoft Azure Services: The Video Indexer service has been renamed to Azure Video Analyzer for Media. Added terms for Azure VMware Solution. Updated Cognitive Services terms to include Applied AI Services.

Microsoft Dynamics 365 Services: Added Dynamics 365 Project Operations From SA to the From SA table.

Online Services Privacy & Security Terms: Added Anomaly Detector, Azure Data Explorer, Custom Vision, Language Understanding, Personalizer, Speech Services, and Translator to the list of Microsoft Azure Core Services.

Professional Services: Several updates have been made to the Professional Services terms. These include updates to the Professional Services introduction language, updates to the Microsoft Premier Support Offerings section to include reference to the Description of Services, and terms for the new Digital Strategy & Enablement (DS&E) Offerings. In addition, terms for the Sales Productivity Accelerator Offerings have been removed as the offer has been discontinued.

Project: Added terms for Universal Resource Scheduling for Project customers. Customers with a Microsoft Project Plan 1/3/5 license(s) are only permitted to use Universal Resource Scheduling to schedule Project and Task tables within the context of a project.  

Promotions: The Free Audio Conferencing for EA/EAS/EES Customers, and Free Audio Conferencing for CSP and Web Direct Customers promotions have been extended from June 30, 2021, to December 31, 2021.

May 1, 2021

Audio Services: Updated License Prerequisites table to add Microsoft 365 Business Basic/Business Standard/Business Premium as prerequisite licenses for Audio Conferencing and Phone System.

Microsoft 365: Added Career Coach (User SL) to availability and prerequisites tables.

Microsoft Azure Services: Added service specific terms for Express Route Global Reach, Azure Kubernetes Service on Azure Stack HCI and Azure Kubernetes Service Runtime on Windows Server. Updated service specific terms for Azure Stack HCI to permit use with Customer Solutions.

Microsoft Dynamics 365 Services: Updated the From SA table for readability, breaking out per user and per device offers. No change to prerequisite licenses.

Microsoft Power Platform: Updated Extended Term Eligibility for EA/EAS/SCE customers to “all” Power Platform licenses. Updated Availability and License Prerequisites table adding Power BI Premium Add-on (User SL).

Microsoft Teams: Added terms for External User entitlements and meeting join license requirements.

Office 365 Suites: Updated the Project for the web clause to be less restrictive, removing the requirement that data must be viewed only through the Project for the web application.

Online Privacy & Security Terms: Added Azure Spring Cloud to the list of Microsoft Azure Core Services.

April 15, 2021

Subscription License Suites: Updated Microsoft 365 Enterprise table, adding F5 Security Add-on, F5 Compliance Add-on, and E5 Compliance offers to the table.

Windows Server Standard, Datacenter, and Essentials: Added the note (to correct an unintentional omission) that Remote Desktop Services CALs are also required to use Windows Server software to host a graphical user interface, and Microsoft Identity Manager CALs are required for any person for whom the software issues or manages identity information. 

April 1, 2021

The Microsoft Graph data connect for ISVs product entry has been deleted as the offer has been retired. Existing customers may refer to the March 1, 2021 version of the terms.

Azure Services: Updated the Azure Maps "API Results" clause to include Azure Maps Weather service results to the displaying results carve out.

CAL and ML Equivalency Licenses: Updated the tables for clarity, combining the Commercial and Academic tables for CAL Suites. Moved table notes to the top of each table.

Microsoft Dynamics 365 Services: Updated the Purchasing Minimums table note to include eCommerce Tier SKU(s). Added Cloud Scale Unit Add-in for Dynamics 365 Supply Chain Management (SL) to the availability table.

March 1, 2021

Audio Services: Added a clause stating that Business Voice customers may not provision more than 300 user subscription licenses.

GitHub Offerings: Updates to GitHub license terms for clarity.

Microsoft Azure Services: Added terms governing access to dev/test pricing in Azure, and service specific terms for Azure Communication Services. 

Microsoft 365: Updated License Prerequisites table adding Office 365 F3 and Enterprise Mobility + Security E3 (K) and Windows 10 Enterprise per device/E3 as eligible license prerequisites for Microsoft 365 F5 Compliance, Microsoft 365 F5 Security, and Microsoft 365 F5 Security + Compliance.

Microsoft Dynamics 365 Services: Dynamics 365 IoT has been renamed to Sensor Data Intelligence Add-in.  

Microsoft Power Platform: Removed the unauthenticated External Users clause from the Microsoft Power Apps section due to technical enforcement of the licensing.

Notices: Updates to Notice about H.264/AVC Video Standard, VC-1 Video Standard and MPEG-4 Visual Standard pertaining to MPEG technology.

Promotions: Removed the Security and Compliance Promotion for Microsoft 365 F1/F3.

Windows Desktop Operating System: Added South Africa and United Kingdom to list of countries for purchase eligibility for Windows 10 Home to Pro Upgrade for Microsoft 365 Business Premium. Added United Kingdom to list of countries for purchase eligibility for Windows 10 Home to Pro Right Licensing for E3/E5.

February 4, 2021

Microsoft 365: Added a new offer, Microsoft Viva Topics (User SL), and updated the License Prerequisites table for this offer. Please note this SKU is called "Topic Experiences" in the February price list. It will be updated to "Microsoft Viva Topics" in the March 2021 price list.

Removed Microsoft Cloud Agreement (via CSP) from the Program selection. CSP terms are now available by selecting the Microsoft Customer Agreement program.

Azure Maps: Added language covering the caching and storing of information delivered by the Mobility API.

Cognitive Services: Updated Cognitive Services entry to include terms for product documentation, limited access services, customized text to speech services, and use of synthetic voices.

Microsoft 365 - Unattended License: Updated terms to clarify there is no Qualifying Operating System requirement when licensing M365 A3/E3 Unattended.

Online Services Privacy & Security Terms: Added Azure Bot Services to the list of Microsoft Azure Core Services.

Promotions: The Free Audio Conferencing for EA/EAS/EES (A3 Only) Customers, and Free Audio Conferencing for CSP and Web Direct Customers promotions have been extended to June 30, 2021.

Software Assurance Benefits: Removed terms for Planning Services and Training Vouchers Software Assurance Benefits, which have been retired as of February 1, 2021. January 1, 2021

Removed individual product references to SLAs. All online service SLAs are stipulated in the Service Level Agreement for Microsoft Online Services, found here: https://www.microsoft.com/licensing/product-licensing/products

Updated Program Availability tables to support the launch of perpetual software in Microsoft Customer Agreement (via CSP program). This includes updates for the following products: BizTalk, Office Desktop Applications, Office for Mac, Exchange Server, Project Server, SharePoint Server, Skype for Business Server, SQL Server, and Windows Server.

Azure Active Directory Premium: Updated External User Allowance clause to state that it is not available to new customers nor customers using (or who have used) the service under a Monthly Active User count.

Azure Health Bot Service: We are adding terms for the Azure Health Bot Service. Customer’s use of the Microsoft Healthcare Bot Service licensed through the Azure Marketplace is/continues to be governed by the Microsoft Healthcare Bot Service terms in the Microsoft Online Services Terms published in December 2020.

Workplace Analytics: Added a license prerequisites table for Workplace Analytics.

Windows Desktop Operating System: Microsoft Defender Advanced Threat Protection (for users) has been renamed Microsoft Defender for Endpoint. All instances in the terms have been updated. No licensing changes.

Microsoft Azure User Plans: Azure Advanced Threat Protection for Users has been renamed Microsoft Defender for Identity. All references in the terms have been updated. No licensing changes.

Microsoft Dynamics 365 Services and Microsoft Power Platform: Common Data Service has been renamed Dataverse. All references in the terms have been updated. No licensing changes.

Exchange Online: Office 365 Advanced Threat Protection has been renamed Microsoft Defender for Office 365. All references in the terms have been updated. No licensing changes.

Microsoft Defender for Endpoint (server): Microsoft Defender Advanced Threat Protection for Servers has been renamed Microsoft Defender for Endpoint (server). All references in the terms have been updated. No licensing changes.

Power Apps Promotion for EA, EAS, and CSP Customers: Added terms for the Power Apps Promotion for EA. EAS, and CSP Customers.

Online Services Privacy & Security Terms: Added SQL Managed Instance to the list of Microsoft Azure Core Services.

November 1, 2020

Removal of Bing Search Services terms: Customers who licensed Bing Search Services under their current Enterprise or Server and Cloud Enrollment or Enrollment for Education Solutions prior to October 30, 2020 continue to be bound by the Bing Search Services Terms in effect on October 1, 2020 for the remainder of their subscription term. All other use is governed by the Bing Search Services terms in the Azure Marketplace.

Core Online Services: Added Synapse Analytics to the list of Microsoft Azure Core Services.

GitHub Offerings: Added terms for the GitHub Enterprise Æ offer.

Microsoft Cloud Healthcare Add-On: Added terms for the Microsoft Cloud Healthcare Add-On offer.

Microsoft Power Platform: Added terms for Power Apps and D365 non-restricted entities.

Windows Desktop Operating System: Updated Qualifying Operating Systems tables to reflect academic licenses purchased via Microsoft Cloud Agreement and Microsoft Customer Agreement.

Universal License Terms for all Online Services, and Universal License Terms for all Software: Updated multiplexing clause for clarity only. No change to intent.

Universal License Terms for all Online Services: Added a clause covering use of the Common Data Service (CDS) when obtained via Microsoft 365 licenses.

Microsoft Azure Services and Server Subscriptions for Azure: Clarified that references to Azure deployment rights mean Customer’s Azure service accounts.

Microsoft Dynamics 365 Services: Updated terms to accommodate the launch of Dynamics 365 Project Operations.

Microsoft Power Platform: Added language covering inactive Common Data Service (CDS) instances.

Microsoft 365: Added terms clarifying use of Exchange Online with Microsoft 365 F1.

Microsoft Azure Infrastructure Plans: Updated Microsoft Azure Stack Hub Plan terms to clarify that licenses are reduction eligible, subject to the requirement of maintaining licenses equal to the Physical Cores on the Server.

Microsoft Azure Services: Added terms restricting the use of Azure Facial Recognition Services by or for U.S. police departments. Added Service Specific Terms for Azure SQL Edge offer.

Microsoft Dynamics 365 Services: Added terms permitting External Users to access Dynamic 365 Remote Assist or Dynamics 365 Guides from devices licensed with Dynamic 365 Remote Assist or Dynamics 365 Guides Device SLs.

Microsoft Intune: Updated Microsoft Intune Add-on chart to include Bridge CALs as eligible licenses.

Storage Array, Azure Data Box, Azure Stack Edge, and Azure Stack Hub Ruggedized Terms: Added terms for Azure Stack Edge and Azure Stack Hub Ruggedized from Microsoft Hardware Terms.

Visual Studio Subscriptions: Updated terms covering production use of Office Professional Plus and M365 Apps for enterprise for Visual Studio Enterprise Subscription customers.

Online Services Privacy & Security Terms: Added Dynamics 365 Customer Insights to the list of Microsoft Dynamics 365 Core Services. Added Microsoft Virtual Agents to list of Microsoft Power Platform Core Services. Added Cortana to list of Office 365 Core Services.

Microsoft 365 Applications: Added terms to clarify that when mobile versions of Microsoft 365 Applications are used with a work or school account to access Online Services, the terms that govern the relevant Online Service apply to that use of the M365 Mobile Applications. Microsoft’s commitments related to M365 Mobile Applications do not extend to data processing, policies, or practices of third-party providers of mobile platforms on which the mobile applications operate (e.g., Apple, Google).

Microsoft Azure Services: Updated the Microsoft Azure Hybrid Benefit table to cover usage of SQL Standard Virtual Machines and Azure Data Factory SQL Server integration Services (Standard) using SQL Server Enterprise (Core) Qualified Licenses and use of SQL Server Enterprise Virtual Machines and Azure Data Factory Server integration Services (Enterprise) using SQL Server Standard (Core) Qualified Licenses.

Microsoft Power Platform: Added purchasing minimums, extended use rights, and prerequisites for applicable licenses.

Server Subscriptions for Azure: Updated the Deployment Options for SQL Server table to cover usage of SQL Standard Virtual Machines and Azure Data Factory SQL Server integration Services (Standard) using SQL Server Enterprise (Core) Qualified Licenses and use of SQL Server Enterprise Virtual Machines and Azure Data Factory Server integration Services (Enterprise) using SQL Server Standard (Core) Qualified Licenses.

Universal Terms for all Online Services: Added language to the Acceptable Use Policy covering the use of the Online Services in a high risk use scenario.

Microsoft 365 Applications: Added terms for device based subscription licensing.

Microsoft Azure Services: Azure Monetary Commitment is now referred to as Azure prepayment.

Microsoft Endpoint Configuration Manager (formerly, System Center Configuration Manager): The product name for System Center Configuration Manager Current Branch is updated to Microsoft Endpoint Configuration Manager. Use of Microsoft Endpoint Configuration Manager continues to require active SA.

Office 365 Services: Added a new entry for endpoint features of Insider Risk Management and Microsoft Information Protection that includes service-specific privacy terms. 

Office 365 Suites: Added a clause for Project for the web data, which states that users licensed for Office 365 (including via M365) are granted view rights access to Project for the web Customer data, restricted for use only within the Project for the web application, on tenants with a Microsoft Project Plan 1/3/5 license(s).

SQL Server: Updated the Use of SQL Server with Container Technology clause to contemplate the Server/CAL License Model.
